Regulatory Context

Florida assumed the federal Section 404 permit program from the EPA in 2020 for most non-navigable waters, making it one of only two states to do so. Delineators must navigate both the state ERP program under FDEP and the five Water Management Districts, each with their own technical standards and mitigation rules - often on top of remaining federal jurisdiction in navigable waters.
